I know the doctor's response before he gives it to me.
I know what he's going to say.
He has to say that the treatment he rendered was the standard of care. He has to.
No doctor is ever going to voluntarily admit that they violated the basic standards of good medical care. Nobody.
You should know that in New York, when I ask the doctor whom you have sued what was the standard of care, he's going to tell me exactly what he did for you was the appropriate standard of care. He has to.
Why would I even bother asking that question?
For many reasons.
The first is that your doctor is considered a learned expert.
He has special knowledge and training that makes him an expert in his field of medicine beyond what an ordinary layperson has. Also, because he has such advanced knowledge, the law allows me to ask him questions about his expertise and his medical knowledge.
These questions are asked in the setting of a question and answer session known as a deposition. There's no judge or jury there. There's only a court stenographer, the doctor and his attorney and me.
The answers the doctor gives me represents his sworn testimony and carries the same exact weight as if he's testifying at trial.
I need to ask the doctor what was the standard of care to establish his knowledge of the standard of care and then determine later on, if his treatment violated the standard of care.
