Your medical malpractice case is coming up for trial.
Another few months to go.
Your attorney hires a medical expert to testify in your trial.
Your expert supports your claim that your doctor was careless and his wrongdoing caused you harm and injury.
Your lawyer does the right thing.
He has to notify his opponent that he's hired a medical expert who will testify at trial. He has to tell the opposing lawyer all of the experts' credentials; where he went to school and did his medical training. He has to let him know what state he's licensed to practice in and whether he's board certified in a particular field of medicine. He's also supposed to let the other side know what hospitals he 's affiliated with and whether he's has any publications.
Oh yes...
One more thing he's supposed to do.
He's supposed to tell the other attorney what his expert will say when he testifies and what he's basing his opinions and conclusions on.
The defense lawyer gets this document (called an 'expert witness reply'). He reads it. He makes a copy of it. Then he puts it in an envelope back to us with a cover letter saying essentially "Take this expert witness reply and shove it!"
